Comprehensive Participant, Spectator, and Minor Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement
NOTICE: THIS IS A LEGALLY BINDING AGREEMENT. PLEASE READ CAREFULLY.
By signing this agreement, you acknowledge that participation in activities at or presence within the Wildcat Athletic Center facility involves inherent risks. By signing, you voluntarily waive certain legal rights, including the right to bring a lawsuit for injuries or damages arising from participation in activities or presence at the facility.

This agreement applies to all members, participants, spectators, visitors, guests, renters, volunteers, and any other individuals present on the premises of Wildcat Athletic Center.

1. DEFINITIONS
For purposes of this Agreement, “Wildcat Athletic Center” and “Releasees” shall include Wildcat Athletic Center, the facility owner, landlord, property manager, affiliated companies, parent companies, subsidiaries, successors, assigns, sponsors, officers, directors, employees, volunteers, agents, contractors, instructors, program operators, and insurers.

2. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand that participation in athletic, recreational, aquatic, and fitness activities involves inherent risks that cannot be eliminated regardless of the level of supervision or safety precautions.
These risks include but are not limited to:
• slips, trips, and falls
• collisions with other participants or spectators
• injuries from athletic play
• contact with balls, equipment, or projectiles
• equipment failure or misuse
• weightlifting injuries
• turf and court surface injuries
• aquatic injuries including drowning or diving accidents
• slips on wet pool decks
• exposure to viruses, bacteria, or other illnesses
• injuries arising from the condition of the facility, equipment, parking areas, walkways, or premises

I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of the Releasees.

3. WAIVER AND RELEASE OF LIABILITY
In consideration for being permitted to enter, participate in activities, observe events, or use the facilities of Wildcat Athletic Center, I hereby release, waive, discharge, and covenant not to sue the Releasees from any and all liability, claims, demands, damages, or causes of action that may arise out of or relate to any injury, illness, disability, death, or property damage occurring while participating in activities, using equipment, or being present on the premises, whether caused by negligence of the Releasees or otherwise.

4. INDEMNIFICATION
I agree to indemnify and hold harmless the Releasees from any and all claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to my participation, my presence at the facility, my negligence, or my failure to follow facility rules or instructions.

5. FACILITY RULES
I agree to follow all posted rules, safety guidelines, and instructions given by Wildcat Athletic Center staff. I understand that failure to follow rules may result in removal from the premises without refund.

6. MEDICAL EMERGENCY AUTHORIZATION
I authorize Wildcat Athletic Center and its representatives to obtain emergency medical care for me if necessary. I understand that Wildcat Athletic Center does not provide medical or accident insurance and that I am responsible for any medical expenses incurred.

7. INSURANCE DISCLAIMER
I acknowledge that Wildcat Athletic Center does not carry medical or accident insurance for participants or spectators and that I am responsible for maintaining my own insurance coverage.

8. PHOTOGRAPHY AND MEDIA RELEASE
I grant permission to Wildcat Athletic Center to photograph, record, or otherwise capture my likeness or voice during participation in activities or events. These materials may be used for promotional, educational, or marketing purposes including websites, social media, print media, and broadcast media. No compensation will be provided for such use.

9. SEVERABILITY
If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

10. GOVERNING LAW AND VENUE
This agreement shall be governed by the laws of the State of New York. Any legal action arising out of this agreement shall be brought exclusively in the courts located in Madison County, New York.

11. ADULT PARTICIPANT CERTIFICATION
By signing below, I certify that:
• I am at least 18 years of age.
• I have read this agreement carefully.
• I fully understand its terms.
• I voluntarily agree to be bound by it.
